Stages Of The Process
The precise stages involved in the sale and purchase of a residential property vary according to the circumstances. However, below are the usual key stages:-
Sale
- Take your instructions and give you initial advice.
- Send you a copy of our Terms and Conditions along with the relevant property information forms that you will need to complete regarding the property.
- Send a draft contract to your buyer’s solicitor along with the completed property information forms.
- Reply to any enquiries regarding the property which may have been raised by your buyer’s solicitor.
- Either ask you to come in to the office or send you the final contract and Transfer Deed for signature.
- Agree a completion date.
- Exchange contracts.
- Complete sale.
- Deal with the repayment of any mortgage and the estate agent’s fees.
- Send you the net proceeds of sale.
Purchase
- Take your instructions and give you initial advice.
- Check finances are in place to fund your purchase.
- Send you a copy of our Terms and Conditions.
- Receive and advise on contract documents.
- Carry out searches against the property (e.g. Local, drainage and environmental).
- Make any necessary enquiries of the seller’s solicitor.
- Report to you on all documents and information received.
- Report to you on the main conditions of your mortgage offer.
- Either ask you to come in to the office or send you the final contract, Mortgage Deed and Transfer Deed for signature.
- Agree a completion date.
- Arrange for all monies needed to be received from the lender and you.
- Exchange contracts.
- Complete purchase.
- Deal with the payment of Stamp Duty Land Tax.
- Deal with the application for registration at the Land Registry.
- Send you all the relevant documents in relation to the property once the application for registration has been completed at the Land Registry.
Complaints
As we are committed to providing you with a high quality service that is both efficient and effective, complaints are thankfully few and far between. However, should there be any cause for complaint in relation to any aspect of our service, please bring it to our attention without delay and we can then take the appropriate action.
Once we have received your complaint, Nicholas Wykeham will write to you within 7 days to explain how your complaint will be investigated if a complete response to your complaint has not been made by that time. You will be told the latest date by which a complete answer will be given to your complaint (this should be not more than 28 days after we receive your complaint). If you have made the complaint verbally, either at a meeting or on the telephone, we will set out in our full response our understanding of the nature of your complaint.
If after following the review process set out above, you remain dissatisfied with any aspect of our handling of your complaint, you may contact direct the Legal Ombudsman’s office to ask them to consider the complaint further. The Legal Ombudsman’s details are as follows:-
